Konturen einer von der Erbschaftsteuer getrennten Schenkungsteuer
Description
In scientific research the gift tax is mostly described as an amendment to the inheritance tax without any further explanation. In actual fact, though, the gift tax exceeds the function of an amendment. It is an independent tax, needs an independent justification and requires a self-contained legal arrangement. For this purpose, and in order to analyse a differentiation to the inheritance tax, the characteristics of the gift tax are reviewed.
Starting point is an independent justification of the gift tax by the ability-to-pay-principle.
The legislative competence of the gift tax does not follow the legislative competence of the heritage tax, but is based on the right to invent new taxes. Because of the clause of necessity in art. 72 para. 2 Grundgesetz (Basic Law), the Federation has only the legislative power concerning the basic rules of the subject matter of the gift tax. All other rules have to be legislated by the single federal states.
The guarantee of the right to inherit contains guidelines for the inheritance tax. The guarantee of the right to inherit cannot be assigned to the gift tax, because the gift tax can only be subject of the guarantee of property. The differentiation in taxation according to the relation with partial high tax-exempt amounts is not considered.
At the end, the influences of the right of the European Union are reviewed and the outline of a gift tax act is drafted.
